NEW WHITELAND TOWN COUNCIL

FEBRUARY 19, 2008

7:00 p.m.

 

 

Council President, John Perrin began the meeting at 7:00 p.m.  Members present were John Perrin, Terry Spencer, Joe Noonan and Don Harris.  Member Scott Alspach and Clerk Treasurer Maribeth Alspach were on vacation.  Department Heads, Jim Lasiter and Ed Stephenson were in attendance.  Brian Hedrick was not present.  Office Manager Cindy Yates is present and filling in for Maribeth tonight.  Lee Robbins was in attendance.

 

The Pledge of Allegiance was said and Joe Noonan said a prayer.

 

MINUTES:

Don Harris motioned to accept the minutes as presented.  Joe Noonan seconded the motion.  Vote was 4 affirmative.

 

HARDSHIPS:

Robin Rice who resides at 837 Westview Drive approached the Council for an extension until February 29th.  Ms. Rice recently started another new job and will pay the full amount of $131.75 on February 29th.  She stated she will put the payment in night drop box on Thursday evening, the 28th.  Council granted Ms. Rice the extension.

 

OLD BUSINESS:

There was no old business.

 

NEW BUSINESS:

CELLULAR TOWER INFORMATION REQUEST:

Jim Lasiter passed out information to the Council.  Unison is a company willing to take over  antenea sites and market them. Jim met with them and they are willing to buy the Town=s current contract, which is a nine year contract.  Unison wants to add 600 square foot to the bottom of the tower.  They will split it 50/50 with the Town.

 

Jim Lasiter has talked with Jeff Birk.  Jeff=s advice is not to sign anything under $81,000.00.  Jim=s advice is nothing under $85,000.00.

 

Jim made it clear that the Council will want the tower to look nice and have control over any antenea that goes on the tower.  Lee Robbins wants to see the wording in the contract pertaining to the Town having control.  Most municipalities are nervous about what the tower will look like.

The Town could not be unreasonable with a denial of an antenea.

 

Jim is asking permission to talk to Unison and have Lee look at contract in order to negotiate a lease with them.  There was more discussion.  The Council agreed that Jim can proceed with negotiations and seek Lee=s legal counsel.

CELLULAR TOWER:

Terry Spencer asked if Unison is only interested in the tower behind the Town Hall.  Jim replied, yes at this time.

 

330 WHITELAND ROAD:

The Town of New Whiteland is interested in purchasing New Whiteland Christian Church located at 330 Whiteland Road.  Terry Spencer motioned for Jim Lasiter to proceed with architectural study, not to exceed $3,500.00. 

 

There was discussion about an appraisal. Lee stated that he made contact with Steve Cobb Jr. who owns Real Property Evaluations.  What is the possibility of the Town getting a price break for an appraisal?  Lee also made contact with Mike Lady, who is an appraiser for Integra.   This company is familiar with the type of work we need. Told Lee to proceed, not to exceed $3,000 on each.

 

POTENTIAL CIRCUIT BREAKER TAX CREDITS:

Don Harris passed out information to the other members concerning potential circuit breaker tax credits.  Don wants the Council to consider this when thinking about 330 Whiteland Road.

 

INDIANA AMERICAN WATER:

Jim Lasiter along with Maribeth and two Council members met with Indiana American Water.  They are interested in buying the water utility, like they were the last time.  They have a new acquisition man, who is more aggressive about making a deal.

 

Service connections fees were discussed.  Jim Lasiter states that he does not want to be partners with Indiana American Water.  Either they buy the entire water utility or they don=t.

 

Currently, Indiana American Water has a customer base of 285,000 customers.  If they bought New Whiteland=s water utility, it would be a capital improvement for them.

 

Jim Lasiter is asking permission to spend around $300.00 to $500.00 for Jeff Birk to conduct a study on selling the water plant to Indiana American Water.  Jim and Jeff agree they should not sell for less than $4,000,000.00.  This acquisition could take about a year to complete.

 

New Whiteland would continue with the sewer plant.  Indiana American Water can do all the billing for water and sewer. First priority is to come up with a purchase price and then proceed.

 

Terry asked what time frame will it take for Indiana American Water to get money to the Town of New Whiteland, if they did billing for wastewater.  Estimated the money would be wired into Town=s account.  Terry stated that he compared the positives and negatives and they came out pretty even.

INDIANA AMERICAN WATER (continued)

Don Harris motioned to approve Jim getting direction from Don Humphrey and Jeff Birk on selling the water utility.  Cost not to exceed $1,000.00 for both firms.  Terry seconded the motion. Vote was 4 affirmative.

 

BUILDING PERMIT FOR PROCTOR PARK IN TRACY COMMONS:

I reported that we received the permit for Proctor Park.

 

ORDINANCE 2075:

Ordinance 2075 was adopted on first reading at the last meeting. This ordinance pertains to water rates and charges.  It was discovered the rate schedule did not include Unmetered Private Fire Services.  Joe Noonan motioned to accept Ordinance 2075 with amendment on first reading tonight.  Don seconded the motion.  Vote was 4 affirmative. This item will be placed for Public Hearing at the next Town Council meeting.

 

ORDINANCE 2076:

Ordinance 2076 pertains to the revisions and compiling of Town Codes.  The Police Department can start enforcing the new rules.  Lee advised no action necessary, these town codes were adopted before.  Don Harris states he would like a disc with the Town Codes on it.  Lee states he will get everyone a disc.

 

EMBARQ:

There was brief discussion about upgrading the phones at the Town Hall.  One quote was $21,000.00 and another $31,000.00.
